Terms of Service

These Terms of Service ("Terms") govern your use of the Linkfly AI SDR platform ("Service") operated by KYLY CST Pte Ltd ("Company", "we", "us", "our"), a Singapore-registered company (UEN: 201900000X). By using our Service, you agree to these Terms.
1. The Service
Linkfly provides AI-powered Sales Development Representative ("SDR") agents on a monthly lease basis. Our agents conduct outreach, qualify leads, and book meetings on your behalf.
2. Eligibility
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization. By creating an account, you represent that this information is accurate.
3. Account Responsibilities
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate business information during onboarding.
- You are responsible for all activity under your account.
- Notify us immediately at support@linkfly.site if you suspect unauthorized access.
4. Pricing & Payment
- Option A: $99/month base fee + $150 per Sales Qualified Meeting (SQM).
- Option B: $299–$499/month flat rate (varies by niche).
- Annual plans: 2 months free on annual commitment.
- Enterprise setup: $1,500 one-time fee (custom configurations).
- All prices are in USD. Payments are processed via Airwallex.
- Subscriptions renew automatically unless cancelled before the renewal date.

5. Performance Guarantee
- We guarantee a minimum of 20 Sales Qualified Meetings (SQMs) in your first month of service.
- If this target is not met, your second month of service will be provided at no charge.
- A "Sales Qualified Meeting" is defined as a booked call with a prospect who matches your Ideal Customer Profile and has confirmed attendance.
- This guarantee applies to Month 1 only and is subject to you providing accurate ICP data and timely onboarding information.
- The guarantee does not apply if service interruption is caused by your actions or failure to provide required access/information.
6. Acceptable Use
You agree NOT to use our Service to:
- Send spam or unsolicited bulk messages in violation of applicable laws (CAN-SPAM, GDPR, etc.).
- Misrepresent your identity or your business.
- Target individuals or businesses in a harassing or deceptive manner.
- Violate any applicable local, national, or international law.
- Attempt to reverse-engineer, copy, or replicate our AI agents or systems.
7. Data & Privacy
- We process prospect data on your behalf to deliver our Service.
- You are responsible for ensuring your use of our Service complies with applicable data protection laws.
- We retain client data for 90 days after account termination.

8. AI-Generated Content & Outputs
⚠️ Important — Please Read Carefully:
Our Service uses artificial intelligence and large language models to generate outreach messages, qualify prospects, and conduct conversations on your behalf. By using our Service, you acknowledge and agree to the following:
- No guarantee of accuracy. AI-generated content — including emails, chat messages, prospect qualifications, meeting summaries, and recommendations — may contain errors, inaccuracies, or statements that do not reflect reality ("hallucinations"). We do not warrant that any AI output is accurate, complete, truthful, or fit for any particular purpose.
- Human review recommended. You are responsible for reviewing AI-generated outputs before relying on them for business decisions. We strongly recommend human oversight of all AI-generated communications, especially those involving pricing, commitments, contractual terms, or legal/regulatory claims.
- No liability for AI errors. KYLY CST Pte Ltd shall not be liable for any loss, damage, reputational harm, missed opportunity, or legal consequence arising from inaccurate, misleading, incomplete, or inappropriate AI-generated content, including but not limited to:
- Factual errors or fabricated information in prospect communications
- Incorrect characterization of your products, services, pricing, or capabilities
- Misrepresentation of prospects' qualifications, intent, or responses
- Inappropriate tone, language, or claims in outreach messages
- AI "hallucinations" — plausible-sounding but false statements
- Decisions made based on AI-generated analysis or recommendations
- No agency relationship. The AI SDR agent acts as a software tool, not as your employee, contractor, or legal representative. Any commitments or representations made by the AI agent in communications with prospects are not legally binding on your behalf unless independently confirmed by you in writing.
- Evolving technology. AI capabilities change over time. Output quality may vary based on model updates, training data, input quality, and other factors outside our control. We make no guarantee that AI performance will remain consistent across updates.
- Your content responsibility. You are solely responsible for the accuracy of the business information, Ideal Customer Profile data, product descriptions, and other inputs you provide. AI outputs are only as reliable as the data they are built on.
- Compliance is your responsibility. You are responsible for ensuring that AI-generated outreach complies with all applicable laws and regulations in your jurisdiction, including but not limited to CAN-SPAM, GDPR, CCPA, PDPA (Singapore), and industry-specific regulations.
9. Intellectual Property
- All AI models, algorithms, training data, and platform technology remain the exclusive property of KYLY CST Pte Ltd.
- Outreach copy and templates generated for your campaigns are licensed to you for business use during your active subscription.
- You retain ownership of your business data, prospect lists, and meeting recordings.
10. Service Availability
- We aim for 99.5% uptime but do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated at least 24 hours in advance when possible.
- We are not liable for downtime caused by third-party services, internet outages, or force majeure events.
11. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
WE EXPRESSLY DISCLAIM ALL LIABILITY ARISING FROM OR RELATED TO AI-GENERATED CONTENT, INCLUDING ERRORS, HALLUCINATIONS, INACCURACIES, OMISSIONS, OR ANY RELIANCE ON AI OUTPUTS FOR BUSINESS, LEGAL, OR FINANCIAL DECISIONS.
We do not guarantee specific revenue, conversion rates, or business outcomes beyond the Month 1 SQM guarantee stated above.
Maximum liability cap: Our total liability — for any and all claims, including those related to AI-generated content — shall not exceed the fees paid by you in the 3 months preceding the claim, up to a maximum of $500 USD. For free-tier users, maximum liability is $0.
IN NO EVENT SHALL KYLY CST PTE LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Cancellation & Termination
- You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
- No refunds for partial months.
- We reserve the right to terminate accounts that violate these Terms, with or without notice.
- Upon termination, your AI SDR agent will be deactivated and data retained for 90 days.
13. Pricing Changes
We may adjust pricing with 30 days' written notice via email. Your continued use after the notice period constitutes acceptance. You may cancel before the new pricing takes effect.
14. Dispute Resolution
- These Terms are governed by the laws of the Republic of Singapore.
- Any disputes shall be resolved through arbitration administered by the Singapore International Arbitration Centre (SIAC).
- You agree to attempt good-faith resolution via email before initiating arbitration.
15. Modifications
We may update these Terms at any time. Material changes will be notified via email or dashboard notification. Continued use after changes constitutes acceptance.
